Photography contracts protect both client and photographer — but most clients sign them without reading. Here is what the key clauses mean and the things everyone should check before engaging a photographer for any significant occasion.
A photography contract sets out what both parties have agreed to: what will be delivered, by when, in what format, at what price, under what conditions. It exists not because photographers expect disputes but because clarity in advance prevents disputes from arising.
The absence of a written contract does not protect the client — it exposes both parties to disagreement about what was agreed. When a client says they expected one hundred images and the photographer delivered sixty, the outcome of any dispute depends entirely on what was written down.
A reasonable photography contract protects both parties equally. Watch for terms that are heavily one-sided — particularly around cancellation, where a contract might specify that the photographer receives full payment if they cancel but the client forfeits all payments if they cancel in any circumstances.
Reasonable cancellation terms typically allow the client to reschedule rather than forfeit if they give sufficient notice (usually 21–30 days). Force majeure clauses (covering events neither party could have foreseen or prevented) should protect both parties equally.
Wedding photography contracts require particular attention because the stakes are higher and the event is non-repeatable. Additional clauses to check:
Any clause that is unclear, unreasonable or misrepresents what you understood was agreed is worth raising before signing. A professional photographer will respond to reasonable requests for clarification constructively; resistance to any discussion of contract terms before signing is itself a signal worth paying attention to.
